No More Blogger in China

China's authority has just blocked Google Blogger. Today, many people in China mainland reported on forum that they can't access their blogs on Blogger any more.

China used to block *.blgspot.com, and we can still visit blogger.com, this time is same. people write their blog, but can't see it on blogspot.

Blogger was unblocked in later July, just because there will have the Olympic game. And now it's the time to block it I think, as the game is over, most foreigners have left China, they don't need to use Blogger in China.

Other sites like Wikipedia, has also been blocked for several times. They can only block the Chinese version for Wikipedia. I have to say, this mothod is really sick. Sometimes they unblock it, then they will check the key words, when the GFW detects words like "Democracy, Freedom, Falun Gong", it will reset the connection, you can retry, but you need to wait about 5 minutes. Most people in China will think it's the problem of web server.

For Blogspot.com, each user will have one domain name like user.blogspot.com, GFW also can check the user name, it can block specific user's blog without blocking whole blogspot. This time they may found too many blogs need to block, so they block us all.

ASUS Charges Customer With Extortion, Customer Countersues

Today's Beijing Times reports on a legal case in which Huang Jing, a young woman who had earlier been accused by computer hardware maker ASUS for extortion, decided to countersue for defamation, selling defected products, and false accusation. The newspaper also reported that Huang demanded a reparation from the State for being "jailed for ten months" before being released due to insufficient evidence.

Huang's ordeal with ASUS started when she was still a university student on February 9, 2006. She bought a V6800V model ASUS laptop from a Beijing retailer. Her computer had many problems including frequent blue screen freeze-ups.

Despite Huang sending back the computer several times for repairs by the ASUS, some of the problems remained. The last time ASUS repaired Zhou's computer, they replaced the CPU, but the new CPU overheated. Examination showed that the new CPU was an Intel "engineering sample" of a kind not permitted to be sold in the market.

Huang and her lawyer, Zhou Chengyu, demanded that ASUS to pay a compensation of five million US dollars, threatening to break the news to the media and take ASUS to court. After rounds of unsuccessful negotiations, ASUS finally rejected all of Zhou's request. Earlier reports quoted Zhou as saying to ASUS that the company "spends tens of millions of yuan on promotion in the Mainland market; if the news was released to the media, the loss of market share would be far beyond 5 million US dollars."

On March 7, 2006 when Huang and Zhou went to ASUS for the last time, they were both arrested by the police at the request of ASUS on charges of extortion.

In December 2006, Huang was released from jail, on parole until her trial. In 2007, the Haidian District procurator issued a decision of exemption from criminal prosecution to Huang deeming the evidence against her inadequate.

Aside from her lawsuit, Huang has also put up a website listing the alleged incidents of ASUS cheating on customers.

Disgruntled customers using media exposure as leverage to bargain with companies is becoming a common phenomenon. This year has seen car owners and home buyers demanding compensation or refunds, threatening negative media coverages.

Asus Gets Customer Locked Up For 10 Months Over Defective Hardware

The Beijing Times is reporting on a shocking court case involving Asus and a young female customer named Huang Jing. It all started back in 2006 when Huang bought a V6800V model ASUS laptop from a Beijing retailer and quickly discovered it to be defective. She sent the computer back to Asus several times for repairs, but the problems persisted. Upon further examination, one of the replacement CPUs used to "fix" the computer was actually an Intel "engineering sample" and therefore unlawful to sell. Now here is where things get really crazy.

At that point, it appears that Huang got herself a lawyer and demanded that Asus pay the equivalent of $5 million US dollars in compensation. If they did not comply, she threatened to break the news of their shady support practices to the media. In March of 2006, Asus had both Huang and her lawyer arrested for extortion. Nearly a year later, she was released after the powers-that-be determined that the evidence against her was inadequate.

Now, Huang is suing Asus again—this time for defamation, selling defected products and false accusation. She has even set up a website detailing Asus' offenses against their customers. It certainly appears that both parties are not free from blame here, so I highly doubt that she will be successful with the lawsuit. Either way, the whole situation is pretty frightning.

是谁把华硕陷入两难困境?

华硕“敲诈门”事件已经在各大媒体纷纷扬扬。我看到后的第一反应,就是想起了数年前的恒升事件。

在那一场引人关注的恒升诉维权消费者一案中(在Google中百度一下,即可获知详情),最终以消费者王洪的败诉(一审赔偿50万,二审赔偿9万)而告终。

恒升赢了,那公众的反馈与舆论评说呢?大家可想而知。一个最典型的声音是:既然敢告消费者,肯定是不拿消费者当回事,笔记本品牌多的是,大不了不买你的就是了。

恒升90年代初市场占有率曾经在前三名以内。1998年销售笔记本电脑2.53万台,销售额3.6亿元,也是全国第一个获得生产许可证的笔记本电脑厂商。但是1999年“王洪案”之后呢?只是留存在我们的记忆中了。

现在的华硕案又进一步升级,从民事案到了刑事案。

案件既然已经到了警方,我们自然不便于评说,而且内幕资料也无从掌握更多。

我看到的是:华硕现在左右为难。以“敲诈勒索”报案,其结局是,无论该两名“嫌疑人”的“敲诈勒索”罪名是否成立,华硕的声誉都将大受影响。

如果构成敲诈勒索,那么敲诈勒索的要件之一是“利用对方弱点缺陷索要财物”,承认了有“弱点缺陷”等于华硕的“芯片问题”有了定论,华硕的产品声誉大受影响。如果不构成的敲诈勒索,华硕的结局则会惨的很难看。

是谁把华硕置入了两难境地?是华硕低能的公关手段。

华硕处理危机,采取“向警方报案”的手段,是否最佳公关手段?如果被逼到了非报案不可的地步,华硕是否要做好充足的准备?

企业处理危机,一般有五项原则:一是迅速反应;二是说真话、赶快说;三是危机处理小组全面介入;四,是邀请第三方协助调查;五是做好善后工作,尽快挽回声誉。

按照这样的原则,华硕本可以不必如此被动。

在没有报案,事件也没有披露之间(即危机预警阶段),华硕的做法应该是:

1、主动查清事实,如芯片问题因自己行为所致(不管是有意还是无意,“无意说”“失误说”都是苍白的辩解),主动赔礼道歉,承担一切损失。然后查明惹祸的“测试芯片”来源,让所有的消费者有知情权,如果必要,可以召回。用主动姿态赢取谅解。

2、如果因消费者要求赔偿的数额过高,自己无法接受,谈判不成,也不能草率报案了之,而是先与消费者协会联络,主动将自己认为可以接受的赔偿款,先行提存消费者协会,树立主动赔偿的形象。

3、由消费者协会作为第三方机构协助调查,并见证事件处理全过程。

4、上述步骤都做完后,就可以静观其变。无论消费者提起维权诉讼,还是向媒体曝光,华硕都会因事前的姿态与行为而占据主动,赢得谅解。无论两名当事人是否存在的行为与动机的瑕疵,华硕的主动行为都可以化解。

中国的消费者群体,其实是世界上最大度、最宽容的消费者群体。如果华硕按上述思路去做,负面影响可以降至最低。

而现在,已经到了危机的顶点了,消费者都从事情的过程中做出了自己的判断:如果芯片没问题,不赔就是了?如果赔偿金额谈不拢,不赔就是了?报警是为了掩盖什么?猜测的声音几乎一边倒。

可笑的是,华硕竟然在关键时刻以沉默应对,理由是“进入司法程序,我们无权评说”。

晕了。对于司法处理你无法评说,但对于最关键的“芯片问题”呢?如何面对公众?如何面对已经购买或即将购买华硕笔记本的消费者?

无论有理没理,“说真话,主动说”的危机公关一定要做,并且要迅速出台善后处理措施。这是华硕可以亡羊补牢的机会。

关注该事件的消费者群体是弱者,但他们手中的人民币是强者呵,货币投票的力量是无穷的。

中国这吃屎的制度

女生黄静因为向华硕所要赔偿而被北京警察监禁10个月,如今却获得国家赔偿,这就说明了警察们犯了错误,但是为什么警察犯了错误要纳税人买单呢?就是因为中国这吃屎的制度啊,警察做错事情不需要负责任。就像城管杀人不需负责一样。

迄今为止没听说哪个警察因为自己错误而付出代价的。

近日,有媒体披露,女大学生黄静及其代理人周成宇控诉,华硕电脑公司使用工程检测用CPU蒙骗消费者,并以敲诈勒索罪报案,致使黄静遭羁押10个月,目前检察院已下达国家赔偿认定书。这场消费纠纷究竟是怎么回事,消费者黄静维权为何引发10个月羁押生活?带着这些疑问,网易新闻访谈见到了当事人的一方——黄静的代理人周成宇,并向华硕公司进行了解和接触。同时,中国政法大学副校长、《国家赔偿法》起草人之一马怀德作客网易新闻,对这起新闻进行了解读。

背景情况:
谈判进行到2月15日,黄静提出,按照华硕年营业额0.05%进行惩罚性赔偿,数额为500万美元,这笔赔偿将用于成立反欺诈基金会。

周成宇(黄静代理人):
我们不会让这个钱到手,这个钱是由华硕公司自己出资、自己管理,钱不会到我们这里来。我们在网上已经公布过几段录音录像,我们不会有任何个人得利,我们不要华硕给一分钱。那些不支持和不理解的人他们所说的就是“你狮子大开口啊?五百万美金,你以为你是美国人啊?”就是这样的论点,我相信大家可能也看到了。真的,我觉得很悲哀。咱们暂时抛开维权基金不说,就黄静自己想要500万美金,何错之有?何罪之有?正是由于中国现在在消费维权方面的立法问题,这些厂商的利益完全因为法律而动摇,就算他违法、就算他欺诈了,他得到的惩罚是什么?没多大惩罚,它完全不在乎。而消费者这边呢?你费很大劲争取到的利益是什么?挽回的权益是什么?没有什么可挽回的。

背景情况:
至此,黄静一方正式向华硕公司宣布终止和解谈判,并决定于3月8日向法院提起诉讼。然而在3月6日,华硕公司连打14个电话,邀请黄静次日来公司继续谈判,此后的事情大大出乎黄静和周成宇的预料。

周成宇(黄静代理人):
到3月6号晚上,郑威最后一次打电话给黄静,说,明天你一个人来,不要带别人,你把那台电脑带着一起过来。第二天,黄静没有带电脑,带着我去了,我们俩一进华硕公司,华硕公司的品牌总监郑威向我们出示了一个华硕公司董事会的决议授权,说我现在代表公司,你们不就是要500万美金吗?那这个事情不用再谈了。中间还有一个小插曲,最开始我们才进会议室时他们还挺客气的,但当时大家都没谈到正事儿上,就是打个招呼,这时候外面有一个华硕的工作人员推门进来,以前我们在里面谈的时候从来都没有人推门进来,这次就是直接推门,敲都不敲,推门进来以后说,郑总,你的客人到了。郑威听了这句话,这肯定是一个暗号,马上态度一下就变了。说“对不起,你们还是要500万美金,那这个事情我们不用谈了。”然后从包里拿出一张授权,说这是公司对我的授权,我全权处理此事,我们不用再谈了。然后我和黄静起身离开,我们走,走到电梯口,就是一群警察,前后包围。

背景情况:
随后,黄静和周成宇二人被送到北京市海淀区看守所关押,据周成宇说,他们当时也曾向警察出示过证据。

周正宇(黄静代理人):
警察看到了,警察把我这张光盘给掰了,但黄静又拿了一张出来,我们开始在刑警队这边,后来刑警队那般又来新的人调查这件事情,黄静那张光盘他们是看了的,那是没有问题的,看了看了呗,一样的抓,一点儿用都没有,华硕可以提供虚假证据,在这么证据确凿的情况下它都可以跟警察说我们从来没修过,好厉害。


【案情回顾】:

2006年2月9日 黄静(化名龙思思)花20900元购买了一台华硕V6800V型笔记本计算机,后因故障不断与华硕进行多次交涉。

2006年2月-3月 黄静正式委托北京市长济律师事务所舒梅律师和周成宇作为代理人处理她因华硕公司在售后服务过程中违规使用不合格产品产生的纠纷事宜;2月14日,黄静在律师舒梅和代理人周成宇的陪同下,携带摄像机前往华硕北京产品服务中心,记录下询问华硕工程师有关该电脑更换CPU一事,黄静与委托人周成宇向华硕公司提出500万美金“惩罚性”赔偿。

2006年3月1日,在英特尔公司促使下,双方开始谈判。

2006年3月,华硕公司报案称:“受到周成宇、龙思思(黄静)等人借华硕公司在维修过程中使用测试版CPU 为由,向华硕电脑敲诈勒索500 万美元。”并且还向警方提供了所谓黄静伙同周成宇自行更换CPU的证据,最终该案件被警方作为刑事案件立案侦查;3月7日 黄静和周成宇被警方控制,后以涉嫌敲诈勒索罪被批准逮捕。

2007年11月7日 海淀区人民检察院以证据不足为由,对黄静做出不起诉决定。

2008年6月5日,北京市义方律师事务所张平律师代理黄静向海淀区人民检察院申请刑事案件错案国家赔偿;6月18日,北京市义方律师事务所律师张平律师、付占平律师,北京市大成律师事务所张斓律师组成华硕维权联合律师团接受受害人黄静的委托处理其与华硕公司、英特尔公司之间的相关法律事宜;

2008年9月22日海淀检察院对黄静做出国家赔偿确认书,具体数额尚在核定中。
